Terms of Service & Acceptable Use
Last updated: October 20, 2026
1. Agreement
These Terms of Service (the "Terms") govern your access to and use of NovaPod (the "Service"). By creating an account, launching an instance, or otherwise using the Service, you agree to these Terms and to the Acceptable Use Policy below. If you do not agree, do not use the Service.
2. The Service
NovaPod provides high-performance and dedicated GPU cloud computing infrastructure. Compute instances are hosted on enterprise hardware operated across verified Tier-3/Tier-4 data centers and certified infrastructure facilities. You are renting compute time and resources on machines for AI training, inference, rendering, and scientific simulation. You are responsible for evaluating the suitability of an instance for your workload.
3. Acceptable Use Policy
You agree to use the Service only for lawful purposes. You must not use the Service to:
- create, store, or distribute illegal content of any kind, including child sexual abuse material (CSAM) or other content that exploits or endangers minors;
- engage in unauthorized access, hacking, credential theft, port scanning, denial-of-service (DoS/DDoS) attacks, botnets, or other network abuse;
- send unsolicited spam, run phishing or fraud operations, or develop and distribute malware;
- infringe intellectual-property rights or violate the privacy of others;
- attempt to tamper with, penetrate, or compromise the underlying host virtualization hypervisor, hardware firmware, or other tenant instances;
- violate any applicable national or international laws, trade controls, or economic sanctions.
4. Enforcement & Suspension
We reserve the right to suspend or terminate any session, pod, or account immediately if we reasonably determine that it violates these Terms or the Acceptable Use Policy, or poses an active security threat to the platform or other users. Terminations resulting from intentional abuse or illegal activity are strictly non-refundable.
5. Content, Data & Ephemeral Storage
You retain full ownership and responsibility for the algorithms, code, models, and data you execute or store on NovaPod instances. Because ephemeral GPU container pods are designed for flexible, high-throughput execution, data stored on unmounted ephemeral scratch disks will be securely wiped upon instance termination. For persistent data preservation, users must utilize dedicated persistent network volumes or KVM root persistent drives. NovaPod does not access or inspect your private model weights or training datasets.
6. Infrastructure & Security Isolation
Hardware made available through NovaPod is provisioned via secure, isolated container runtimes with direct GPU PCI-passthrough or dedicated KVM hypervisors. Each tenant operates in an isolated environment with independent memory space and private networking layers, preventing unauthorized cross-tenant data access.
7. Billing & Cryptocurrency Settlements
NovaPod accounts are funded via non-custodial on-chain cryptocurrency transactions (including USDT, USDC, SOL, ETH, BNB) or approved payment gateways. Metering is calculated on a per-second precision basis while your instance is active. Because digital asset blockchain transactions are immutable, confirmed on-chain deposits and utilized compute credits are non-refundable once consumed by running workloads.
8. Service Availability & Maintenance
NovaPod maintains continuous uptime monitoring and automated health check systems. While we strive for 99.9% hardware availability, scheduled maintenance windows and unexpected upstream datacenter power/cooling events may occasionally require instance migration. Users are encouraged to checkpoint training states at regular intervals.
9. Disclaimers & Warranty
The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. While NovaPod implements automated health checks, uptime monitoring, and failover capabilities, we do not warrant that instances will be uninterrupted or error-free during localized hardware failures.
10. Limitation of Liability
To the maximum extent permitted by applicable law, NovaPod and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or revenue arising out of or related to your use of the Service. In all cases, NovaPod's total aggregate liability shall not exceed the amount paid by you for the specific compute rental giving rise to the claim.
